Important: Please take note that upon registering with myDoorian.com and participating in its program(s), you will be subject to the Terms of Use and conditions set in this program. If you do not agree to the terms, please do not register or participate.
1. Mobmedia Asia Sdn Bhd (hereinafter referred to as "MobMedia") is a corporation organized and existing under the laws of Malaysia and having its principal office at Ground Floor, No 21 Jalan Telawi 3, Bangsar Baru 59100 Kuala Lumpur, Malaysia.
2. MobMedia owns and operates a website and mobile advertising program called ‘myDoorian’ via website address ‘www.mydoorian.com’ and Malaysian mobile shortcode ‘39111’.
3. You (hereinafter referred to as "Publisher") voluntarily agree to participate in the myDoorian program, in exchange for compensation in the forms of cash or cash equivalents when receiving mobile advertisements (SMS, MMS or Video) from myDoorian Advertising Partners.
ADVERTISING
4. The Publisher agrees to receive mobile advertisements, in the forms of SMS or MMS messages. myDoorian will try its best to customize and schedule the advertisements according to Publisher demographic and lifestyle preferences, as per determined by the Publisher upon registration with myDoorian.
5. In return for receiving mobile advertisements, myDoorian shall reward the Publisher with cash (or cash equivalent) commissions for advertisements received via SMS or MMS. The amount varies according to the type of advertisements and number of ads received by the Publisher. Payment calculations will be at the sole discretion of myDoorian and depends on market supply and demand. All commissions will be paid in Malaysian Ringgit (MYR).
PAYMENT
6. The Publisher will receive payment every time its account reaches RM50.00. Upon surpassing the RM50.00 payment threshold, MobMedia will automatically send the cheque via mail within 2-3 weeks to the Publisher’s mailing address, as per registered by the Publisher. Once payment is made, the amount will automatically be deducted from Publisher account.
FRAUD
7. Any attempt by the Publisher to cheat, misuse, misrepresent, manipulate, breach or hack into the myDoorian system will constitute breach of the Terms of Use, and MobMedia reserves the right to suspend the Publisher’s account without warning and any compensation will be forfeited.
8. myDoorian reserves the right to refuse service to particular individuals or entities, at its sole discretion, with or without cause.
PRIVACY
9. At myDoorian, we recognize that privacy is important. myDoorian shall, to the best of its abilities, keep all records confidential.
10. The only other instances where we disclose your information is; (i) when it is required or permitted by law i.e. where disclosure is required or permitted under legislation or regulation, government agency or court order; (ii) when it involves the public interest i.e. where disclosure is required to protect the interest of the public for example in the detection of crimes, etc; (iii) where it is authorised by you.
DISCLAIMERS AND WARRANTIES
11. myDoorian services are provided on an ‘as is’ and ‘as available’ basis. myDoorian does not warrant that the service will be uninterrupted, error-free, or free from viruses or other harmful components. myDoorian makes no express or implied warranties, including without limitation warranties of title, non-infringement, mechantability, or fitness for a particular purpose. No advice provided by myDoorian or any of its representatives will create a warranty.
12. myDoorian will not be liable for any consequential, incidental, exemplary, punitive, or multiple damages, even if myDoorian was advised in advance of the possibility of such damages.
13. myDoorian or MobMedia will have no liability whatsoever for any claims, losses, actions, damages, suits, or proceedings resulting from: (i) myDoorian customers or partners; (ii) security breaches; (iii) eavesdropping; (iv) denial of service attacks; (v) interception of traffic sent or received using myDoorian service; (vi) customer’s reliance on or use of the service; (vii) mistakes, omissions, interruptions, deletions of files, errors, defects, delays in operation, or other failures of performance of the service; (viii) the accuracy, completeness, and usefulness of the service; or (ix) loss of data or loss of access to data.
14. myDoorian’s limitations and exclusions of liability apply equally to myDoorian’s officers, employees, agents, contractors, representatives, suppliers, subsidiaries, parents, and affiliated companies.
